Terms and Conditions

1. Introduction 

These Terms and Conditions (“Terms”) govern the relationship between Photo by JN (“we,” “us,” or “our”) and you, the client (“Client,” “you,” or “your”) for photographic services provided by the Studio. Please read these Terms carefully before booking an appointment or using our services. 

 2. Booking and Payment 

Booking: Bookings can be made through our website, phone, email, or in person. 

Payment: A non-refundable deposit of 50% of the total payment is required at the time of booking to secure your appointment date and time. The remaining balance is due on the session date. We accept payment in cash or via Zelle transfer. 

Rescheduling: To reschedule your appointment, we require notice at least 72 hrs. before the session. A rescheduling fee of $100 may apply for changes made within 3 days of your original appointment date. 

3. Cancellation Policy 

Client Cancellation: Cancellations made 3 days or more before your session will result in a full refund of your deposit. Cancellations made within 48 hrs. to your session will forfeit the deposit. 

Photo by JN Cancellation: In the unlikely event, Photo by JN needs to cancel your session due to unforeseen circumstances, we will offer you a full refund of all payments received or the option to reschedule your session for a mutually agreeable date. 

4. Service Description 

The specific services included in your session will be outlined in your booking confirmation. Additional services may be requested and added to your session with an additional fee. 

5. Image Delivery and Usage 

Delivery Time: Edited images will be delivered to you via an online digital gallery within the number of days specified in the service package you choose. 

Copyright: The Studio retains copyright of all images. You are granted a non-exclusive, personal use license to reproduce and share the images for personal, non-commercial purposes. 

Commercial Use: Any commercial use of the images requires written permission from the Studio and may incur additional fees. 

6. Client Conduct 

Clients are expected to arrive at their session on time and behave in a professional and respectful manner throughout the session. The Studio reserves the right to terminate the session at any time if the Client’s behavior is disruptive or unsafe. 

7. Model Release 

For sessions involving minors, a signed model release form from a parent or legal guardian is required before the session can commence. 

8. Disclaimer and Limitation of Liability 

The Studio takes all reasonable precautions to ensure the safety of your belongings during your session. However, we are not liable for any loss or damage to personal items. 

The Studio is not liable for any delays or cancellations caused by factors beyond our control, such as weather, equipment malfunction, or illness. 

9. Entire Agreement 

These Terms constitute the entire agreement between the Client and the Studio regarding the services provided. 

10. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland. 

11. Dispute Resolution 

Any dispute arising out of or relating to these Terms shall be settled by the parties who will try, in good faith, to resolve the matter within 30 days.  

12. Severability 

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
